These Terms of Service are an agreement between you and IQTRONICS INC, a California corporation ("IQtronics," "we," "us"), which operates the IQTrack app, trackers, and tracking service. By creating an IQTrack account or activating a tracker, you agree to these Terms. If you do not agree, do not use the app or the service.
You must be at least 18 years old, or the age of majority where you live, to create an IQTrack account or buy service. IQTrack is not directed to children.
IQTrack is intended for tracking property, vehicles, and assets you own or have explicit authorization to track. You may not use IQTrack to track a person without their knowledge and consent, or for any purpose prohibited by federal, state, or local law, including stalking, harassment, or surveillance of another person without lawful authority. You are solely responsible for ensuring your use of a tracker complies with the law in your jurisdiction. Laws differ from state to state, and some require written consent even between spouses, or documented written notice before tracking an employee's vehicle. Placing a tracker on a person, or on a vehicle you neither own nor have documented authorization to track, may be a crime under federal and state law.
If you believe an IQTrack tracker has been placed on you or your property without your consent, contact us right away at support@iqtrackgps.com. We will help you identify the device, and on valid legal process we will cooperate with law enforcement. We suspend or terminate any account we find is being used to track a person without their consent.
You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.
IQTrack depends on cellular connectivity, GPS signal, and third-party mapping services. We do not guarantee continuous, uninterrupted, or error-free operation of the tracking hardware or software.
IQTrack service plans are sold per tracker: \$19.99 per month, or \$192.00 per year. Prices are in U.S. dollars and do not include applicable taxes. Plans and prices are shown in the app before you pay. Payments are processed by Stripe; we never receive or store your card number.
If you turn on auto-renew, your plan renews automatically at the end of each billing period and your payment method is charged the then-current price, until you cancel. You can cancel at any time, by yourself, in the app: open Service & Billing and switch auto-renew off. No phone call and no email are required. Cancelling stops future charges; service you have already paid for runs to the end of the period you bought.
We will tell you by email before any price change takes effect, and an increase applies only to billing periods that begin after that notice.
If your service lapses: when a plan ends and is not renewed, the tracker stops reporting, but its SIM card is held for 60 days. Renew at any time within those 60 days and the tracker resumes on the same SIM at the normal plan price, with no extra charge; the app shows the date your 60 days end. After 60 days the cellular carrier permanently retires the SIM, and the tracker can only be brought back with a replacement SIM card. A replacement SIM costs a one-time $25.00 fee, which includes shipping within the United States, plus a new service plan.
Except where a refund is required by law, sales of trackers, SIM cards, and service periods are final. If something arrives faulty or the service does not work as described, contact support@iqtrackgps.com and we will make it right.
THE SERVICE AND HARDWARE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some states do not allow the exclusion of implied warranties, so this may not apply to you.
To the maximum extent permitted by law, IQtronics is not liable for indirect, incidental, special, or consequential damages arising from use of or inability to use the service, including damages resulting from a tracker's misuse by any party. Nothing here limits liability that cannot be limited by law.
We may suspend or terminate accounts that violate these Terms, including any use that violates Section 2 (Permitted Use). You may close your account at any time in the app: Account → Privacy & Security → Delete Account.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Los Angeles County, California, and you and we consent to the jurisdiction of those courts.
Before filing anything, please email support@iqtrackgps.com and give us 30 days to put it right. Most problems are faster to fix than to litigate.
Nothing in this section limits your rights under California's Automatic Renewal Law or the California Consumer Privacy Act.
We may update these Terms from time to time. When we do, we will change the effective date above and, for material changes, tell you in the app or by email. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
